Entering The U.S. On Fiancé Visas
One of the most important things to understand about fiancé visas is that timing is critical. In most cases, you should have met with your American fiancé(e) within the last two years. If the United States Citizenship and Immigration Services (USCIS) federal agency issues you a K-1 visa, you will be expected to marry your American fiancé within 90 days. The 90-day countdown begins when you arrive in the United States. Therefore, a K-1 visa is not appropriate if you are dating an American but do not have firm plans to marry on a certain timetable.
Proving Eligibility To Marry
Another important criterion for a K-1 visa involves proving your eligibility to marry. You will need to document your eligibility for marriage. You should be old enough to marry. You should not be married or have any legal impediments related to a recent divorce.
Each Case Is Unique — Consult With An Attorney
Please note: Individual circumstances can vary greatly. We strongly suggest that you consult with an experienced immigration attorney in plenty of time to help you obtain an immigrant visa on the basis of engagement to an American.
